ABSTRACT
This research paper discusses various international & regional instruments supporting the
principle of non-refoulement. It is contented that the principle forms part of customary
international law & as such it is binding on all States irrespective of whether or not they are
parties to the 1951 Convention Relating to the Rights of Refugees & its 1967 Protocol Relating to the Status of Refugees.
This research paper also assesses the States practice with regard to the principle of non-
refoulement& it is concluded that States accepts this principle in documents but violates in
practice. The impact of this practice reflects the need for a new provision meeting the needs of new era.
The supervisory mechanism given in convention is also discussed & analyzed in this
research paper.


INTRODUCTION
The principle of non-refoulement is basically a tool to provide protection to an individual
or to a group who doesn‟t enjoy the protection of their country of origin and are at the border of another State or have entered it looking for such protection.
It has been a matter of consistent debate over the last fifty years whether the principle of
non-refoulement has qualified the status of a norm
